Welcome to Lumendat. Throughout this document, "we," "us," and "our" refer to Lumendat. We run this website and store — along with everything connected to it, including our content, tools, features, and product offerings — to bring you a well-curated shopping experience (which we'll refer to as the "Services"). Our store is built on the Shopify platform, which supports our ability to deliver these Services to you.

These Terms of Service lay out what you can expect from us and what we expect from you when using our Services. We'd ask that you read through them carefully, since they touch on important legal matters, including how warranties are handled and where our liability is limited.

By browsing, interacting with, or otherwise using our Services, you're agreeing to these Terms as well as our Privacy Policy. If something here doesn't sit right with you, we'd ask that you refrain from using our Services.

Section 1 — Accounts and Access

By agreeing to these Terms, you're confirming that you've reached the age of majority wherever you happen to live. Accounts are personal to you and can't be handed off, sold, or transferred to anyone else. You're responsible for keeping your login information secure and for anything that happens under your account.

Section 2 — About Our Products

We work hard to represent our products as accurately as possible, but keep in mind that colors and details can look slightly different depending on your screen or device settings. We can't promise that what you see online will be an exact match to the product you receive. Descriptions of our products may be updated at any time, and we retain full discretion to limit how much of an item is available or to stop carrying it altogether.

Section 3 — Placing an Order

Submitting an order is essentially you making us an offer to buy. We're allowed to accept or turn down any order, for whatever reason. Nothing is finalized until we've confirmed your order and received payment, so we'd suggest double-checking everything before hitting submit. Any returns or exchanges will follow the terms laid out in our separate Refund Policy.

Section 4 — Pricing and Payment

We reserve the right to adjust our prices whenever necessary, without advance notice. Whatever price is shown at checkout and confirmed in your order confirmation email is what you'll be charged. Unless we say otherwise, listed prices don't already include taxes, shipping fees, or any import-related charges. It's on you to make sure the payment information you give us is accurate and to keep it current.

Section 5 — Shipping

Any delivery timeframes we give are just estimates, not guarantees. We can't be held responsible for delays that stem from carriers, customs processing, or anything else outside our control. Once your order leaves our hands and is handed to a carrier, responsibility for it transfers to you.

Section 6 — Intellectual Property

Everything you see on our Services — trademarks, images, written content, video, audio, and how it's all arranged — belongs to Lumendat or to those who've licensed it to us, and it's protected under intellectual property law. You're not permitted to copy, distribute, alter, or share any of this material without getting our written permission first. Any rights we haven't specifically granted to you remain ours.

Section 7 — Third-Party Tools

From time to time, we might give you access to tools built by outside companies. These are offered exactly as they are, with no guarantees or endorsement from us, and we won't be held liable for how you choose to use them.

Section 8 — Links to Other Sites

You may come across links on our site that lead elsewhere. We don't control, vouch for, or take responsibility for what you find on those other sites, so anything you do there is at your own risk.

Section 9 — Our Use of Shopify

Lumendat's store runs on Shopify's infrastructure, but any purchase you make is a transaction directly between you and us. Shopify plays no role in and bears no responsibility for what happens in that transaction, and by using our Services, you agree not to hold Shopify or its affiliates liable for anything arising from it.

Section 10 — How Your Privacy Is Handled

Any personal details we gather through our Services fall under our Privacy Policy. Using our Services means you've read and understood how that policy works.

Section 11 — Sharing Feedback With Us

Should you send us reviews, suggestions, or any other kind of feedback, you're giving Lumendat a license — one that's free of charge, doesn't expire, and applies worldwide — to use, adapt, publish, and share that content however we see fit. By submitting it, you're confirming it's yours to give.

Section 12 — Mistakes and Corrections

Every so often, our Services might contain a typo, an incorrect price, or something left out. When that happens, we're allowed to fix the error, and if needed, cancel or adjust an order that was placed based on that inaccurate information.

Section 13 — Acceptable Use

Our Services are meant to be used lawfully. That means no using them to break any laws, infringe on someone's intellectual property, harass or hurt other people, spread malicious software, scrape or harvest personal data without permission, or otherwise disrupt how the Services function for others. Anyone who breaks these rules risks having their access cut off.

Section 14 — Ending Access

We're able to cut off your access to our Services at any point, without needing to give advance notice. If you owe us anything at the time, that obligation doesn't go away. Certain sections — like those covering intellectual property, indemnification, warranty disclaimers, and liability limits — will remain in effect even after your access ends.

Section 15 — No Warranties

Our Services and the products we sell come exactly as they are and as they're currently available, with no warranties attached, whether stated outright or implied — this includes any implied promises around merchantability, suitability for a specific purpose, or non-infringement. If you live somewhere that doesn't allow this kind of disclaimer, it may not fully apply to you.

Section 16 — Limits on Our Liability

As far as the law allows, Lumendat, along with our affiliates, leadership, staff, agents, and licensors, won't be responsible for indirect, incidental, special, or consequential damages tied to your use of our Services or products — including things like lost profits, lost data, or the cost of replacing something — no matter whether the claim is framed as a contract issue, a tort, or something else, even if we'd been told such damages were possible.

Section 17 — Indemnification

You agree to defend and cover Lumendat, Shopify, and each of our respective affiliates, leadership, employees, agents, and licensors against any claims, losses, or expenses that come from you breaking these Terms, violating a law, or misusing our Services.

Section 18 — If a Provision Fails

Should any part of these Terms turn out to be unenforceable or invalid, that piece will simply be removed while the rest of the Terms continue to apply as normal.

Section 19 — The Full Agreement

These Terms, together with our Privacy Policy and any other policies we reference, make up the complete understanding between you and Lumendat regarding your use of our Services, and they replace any earlier agreements on the subject.

Section 20 — Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any disputes arising from your use of our Services will be subject to the jurisdiction of the courts located in Florida.

Section 21 — Updates to These Terms

We may revise these Terms whenever necessary. When we do, the changes will be posted here, and we'll notify you as required by applicable law. If you keep using our Services after an update goes live, that means you've accepted the new version.
